1.  WHO YOU ARE CONTRACTING WITH

We are Wisp Marketplaces (Pty) Ltd. We own and run www.stintz.com.

These terms, and any disputes relating to it, is governed by South African law.

2. OUR SERVICES AND FEATURES

We provide a marketplace

Stintz links families with community-based help. There are other bells and whistles too.

Our marketplace allows you to offer your services or request a service, whether pet sitting, au pairing, coaching, tutoring, house sitting or something else. To request or offer a service, you must create a profile and complete some personal information to ensure that you match with users in your area.

Some features will only be available to you if you give us your location information, for instance, the feature where we link you with service providers in your area.

The Stintz marketplace offers in-app messaging, in-app payments, calendar and bookings, ratings and reviews.

Important: We are not an agency. This means that we do not verify or vet individual users. You should do your own checks before requesting or providing a service.

If you want to request services

You must be – at least 18 years old to request a service.

If you want to offer services

You may offer your services if you are at least 16 years old. If you are younger than 18, you must have your parent or legal guardian’s permission.

3. SUBSCRIPTIONS AND PAYMENT

Your first listing is on us. When you create additional listings, we may charge a subscription fee. Read more about subscriptions and pricing in the FAQs.

You will lose access to subscription-only services and features if we do not receive payment on the subscription renewal date.

You can cancel your subscription at any time by unsubscribing when logged into www.stintz.com.  Your profile will be active until the end of the relevant billing period.  Thereafter your listings will not be active anymore until you subscribe again.

You can cancel your subscription within seven days, and we will refund what you paid.

4. THE RULES FOR USING STINTZ

Stintz’s success is dependent on everyone’s honesty and good intentions. You must not do anything malicious, illegal or dishonest. For instance, you must not:

• allow anybody else to use your profile and login details;
• misrepresent yourself, your skills, or anything about yourself;
• use other people’s intellectual property without their authorisation;
• extract, copy or use any user’s personal information for any purpose other than offering your services or requesting services catered for on Wisp;
• use automated means (like spiders, crawlers or interfaces that we have not authorised) to access Stintz or its features, extract data, or otherwise interfere with or modify functionality or page rendering;
• transmit or post any file that may be contaminated or contain destructive elements that interfere with the performance of the marketplace, for instance, worms or viruses;
• reverse engineer any aspect of our services or do anything that might discover our source code; and
• try to bypass our firewalls and other security measures used to prevent or limit access to any content, area, or code of the site or its features.

Our policy is only to allow fair, independent, honest and objective reviews. You must not post any content or engage in any activity that:

• is harmful, threatening, abusive, harassing, indecent, defamatory, discriminatory, vulgar, profane, hateful, or invasive of other’s privacy;
• constitutes an inauthentic review or one that you know to be incorrect;
• violates any third-party right, including the right to privacy or any intellectual property rights;
• is illegal; and
• is an attempt to impersonate another person or entity.

If we become aware of this type of content (and please let us know if you spot anything), we have the right to remove that content.

5. WHERE OUR RESPONSIBILITIES END

Our services are not specifically designed to meet individual requirements. It is provided on an ‘as is’ and ‘as available’ basis. We do not make any warranties or representations other than those in this contract.

You use the marketplace and its features at your own risk.

To the extent allowed by applicable law, you cannot hold us responsible for any loss or harm you suffer because you used, or could not use our service.

We are not involved in or responsible for the services provided by users listed on the marketplace. We cannot be held responsible for their actions or failure to act, the services they provide or request, payment arrangements between users, or any related activity.

We do not actively monitor or moderate ratings and reviews and cannot be held responsible. If you notice a malicious, abusive, or threatening review or an inauthentic or knowingly erroneous review, please notify us immediately at [email protected].

You must keep your username and password safe. You cannot hold us responsible for the unauthorised use of your account.

If you breach this contract, you will be held responsible for any claims, demands, causes of action, damages, legal and other costs, expenses, penalties, losses, or liabilities due to third-party claims.

Although we will try to prevent it from happening, we are not responsible for any malicious code (such as a virus) which may come from this website.

6. WE MAY RESTRICT YOUR ACCESS

We may restrict or temporarily suspend access to the website for technical, maintenance, or security reasons without compensation. We will do our best to minimise this type of interruption.

We may also restrict or suspend access if we find that:

• an unauthorised person is using your profile;
• you breach this contract or any applicable law; or
• you use the website to harass, abuse, stalk, threaten, defame, or otherwise infringe or violate the rights of any other person.

7. LINKS TO OTHER WEBSITES

Sometimes, we link to third-party websites that are not ours or under our control, so we cannot accept responsibility for their quality, content, nature, or reliability.

8. WE OWN THE COPYRIGHT

This website and all content and other materials it contains, including our logo, all designs, text, graphics, pictures, information, data, software, sound files, and other files and their selection and arrangement (collectively, we call this the ‘content’), are the property of Wisp Marketplaces (Pty) Ltd or are licensed to us unless we indicate otherwise.

The listings and user profiles are provided by users and belong to them.

You may only use the content for its intended purposes. You may not:

• sell, resell, or use the services commercially;
• distribute, publicly perform, or publicly display any content without our written permission;
• modify or derive any uses of the services or content, or any portion thereof;
• use any data mining robots, AI or similar data gathering or extraction methods; or
• download (other than page caching) any portion of the services or content, except where we have given you permission.

The services and content may include software components provided by third parties that are subject to separate licensing terms, in which case those licensing terms will govern those software components.

9. HOW WE TREAT YOUR PERSONAL INFORMATION

The more information you provide in your profile and listings, the greater chance of a successful match. But please don’t overshare. Read about how we treat your personal information in our Privacy Policy.

10. FEEDBACK AND COMPLAINTS

We welcome your questions, comments, suggestions, or ideas about our service.

We will own any feedback and may use and modify it without any restrictions or payment to you. We will not publish your personal information with the feedback without your permission.

11. WHEN THIS CONTRACT ENDS

You can deactivate your profile by emailing [email protected].

We can deactivate your profile by giving you notice at any time if:

• you breach this contract or any applicable law;
• we have reason to believe that your profile is being used fraudulently;
• if we decide to withdraw the service from public use; or
• if we no longer do business.

We are not responsible for any damages or losses you may suffer because your contract is terminated.

When this contract is terminated, for whatever reason:

• you won’t have the right to access the services, and
• any licenses and rights granted under this contract will terminate immediately.

Even after the contract is terminated, these terms will survive.
